Power to Enter into Contracts

 

Under Section 444(b)(1)(vi) of the Local Government Code, a municipal mayor is required to secure the prior authorization of the Sangguniang Bayan (municipal council) before entering  into a contract in behalf of the municipality. The law speaks of prior authorization and not ratification with respect to the power of the local executive to enter into a contract on behalf of the local government unit.1
