What is a contract of insurance?

 

It is an agreement whereby one undertakes for a consideration to indemnify another against the loss, damage or liability arising from an unknown or contingent event. (Sec. 2[1], Insurance Code) Note: A contract of insurance is still a contract, thus it must have all the essential elements of a valid contract as enumerated in Art. 1318 of the New Civil Code.
